Terms of use
Terms of use
1. Platform and contracting parties
Modellwelt is operated by Peter Rufener, Hauptstrasse 24
3806 Bönigen
Switzerland. Contact: site@modellewlt.online. These terms govern the use of modellwelt.online and modellwelt.ch. The platform supports fixed-price sales, optional price proposals, the display of private collections and discussion of articles. It is not an auction platform.
A purchase contract is between the seller identified in the listing and the buyer. The platform operator provides the technical functions and is a seller only where the listing expressly identifies the operator as such. Sellers are responsible for their listings and fulfilling their sales.
2. Accounts and access
Account information must be accurate and current. Keep access credentials confidential and report suspected misuse to the operator. Anyone carrying out a legally binding action must have the necessary authority and legal capacity or the required permission. New registrations require express acceptance of the published terms; the accepted text and timestamp are recorded.
Orders, price proposals, discussion posts, reviews and reports require an active account with a verified email address. Selling functions require the corresponding permission. You must sign in again after 60 minutes without user activity. A verified email address does not establish a member's identity, reliability or ability to pay.
3. Listings and collections
Sellers may list only articles they are entitled to dispose of and which may lawfully be sold. Information about brand, model, authenticity, condition, use, packaging, completeness, price and postage must be accurate. Known defects and missing parts must be clearly described. A set listing must identify the components included. Sellers must fulfil the disclosure, tax and other duties applicable to their own private or commercial sales.
Images and text may be used only with the necessary rights. Collection items labelled "Not for sale — private collection" are not sales listings and cannot be purchased through that display.
4. Fixed-price purchases and price proposals
Before ordering, the buyer checks the article, condition, seller, price, postage, offered payment methods and delivery address. Entries can be corrected in the form before submission. The order button expressly indicating an obligation to pay submits a binding order. If the listing remains available and the order is successfully created, a purchase contract with the identified seller is formed for the displayed total. Order details are available in the account; related messages are sent to the registered email address.
Where price proposals are enabled, the buyer confirms before submission that acceptance creates an order at the proposed article price plus the stated postage. A pending proposal does not reserve the article. An order is created only if the seller accepts in time and the article remains available. The seller is not obliged to accept a proposal. Proposals below the seller's set minimum price may be declined automatically; questions about processing may be addressed to the operator.
The article and postage amounts payable are shown during the transaction. A price reduction or watermark is not a special guarantee of authenticity, quality or delivery. Orders are available for the delivery countries enabled by each seller among Switzerland, Germany, Austria, Italy, France, the Netherlands, Spain, Portugal, Poland and the United Kingdom. The CHF, EUR, PLN or GBP currency shown in the offer and the postage for the selected delivery country apply. Modellwelt does not convert currencies. Cross-border deliveries may incur additional import charges and customs clearance fees depending on the countries involved; the platform does not calculate these.
5. Payment, delivery and complaints
The buyer pays the seller directly using a method offered by the seller. The platform operator does not hold the purchase price in escrow or provide its own payment guarantee. Opening a payment link does not confirm payment. The seller checks actual receipt of funds and keeps order and shipping status accurate.
Buyer and seller deal with payment, handover or shipping, agreed delivery times, defects, returns and refunds between themselves. The conditions agreed at purchase and applicable law govern. These terms do not make a blanket exclusion of statutory defect remedies or mandatory consumer rights. A technical cancellation does not settle the parties' claims. Administration may also be informed where there are indications of abuse.
6. Seller fees
Sales may be subject to commission. The rate applicable to the seller account and communicated before the sale governs; individual accounts may expressly be exempt. Commission is calculated on the article amount excluding postage and billed after payment is confirmed. Recorded refunds of the article price are reflected in commission billing. Other fees arise only if agreed.
Commission invoices are provided in the seller's account and through the registered email address. The payment deadline, tax information and payment details are set out in the invoice and the applicable fee agreement. Sellers must accurately record payments, cancellations and refunds. New rates must be communicated before they apply; completed sales retain their recorded rate.
Positive commission invoices are subject to a minimum billing threshold configurable by the operator; the default is 10.00 in the relevant shop currency. Amounts and credits in different currencies are not offset. The current threshold displayed in the seller account applies. The amount that counts is the balance actually payable, including any applicable VAT and after applying available credits. Amounts below the applicable threshold are carried forward to the next statement and are not waived. Credit notes are issued regardless of this threshold. Individual seller exemptions remain effective; no minimum commission is charged per sale.
7. Discussions, reviews and reports
Contributions must relate to the article or the actual transaction and remain factual and respectful. Discussions and reviews must not contain links or web addresses, spam, unlawful content, threats, discriminatory or hateful statements, sexualised content or disturbing depictions. Other people's personal data must not be published without authorisation. Reviews may concern only the member's own transaction completed through the platform.
New and edited discussion posts and reviews are checked automatically using local text rules. Content without an automatic flag is published without prior manual approval, subject to existing moderation restrictions. Automatically flagged content is held; administration reviews this content and reports submitted by members. Automatic publication or manual approval does not certify a contribution's truth or a member's reliability. Members can report contributions and accounts. Reports must be made in good faith and must not be used to harass others.
Administration may hold, reject or remove content, close discussions or restrict or block accounts for rule violations. A review of a moderation decision may be requested through the contact in the legal notice. An account block does not cancel existing purchase contracts, payment obligations or valid claims.
8. Rights in uploaded content
Rights in images and text remain with their respective holders. Uploading grants the operator a non-exclusive permission, limited to what is needed for platform operation, to store, display, technically adapt, resize and apply the intended watermark to the content. This permission serves the publication chosen and the processing and documentation of related transactions. It does not transfer ownership or authorise arbitrary reuse for unrelated purposes.
9. Availability and responsibility
The platform is maintained on an ongoing basis. Maintenance, faults or security measures may temporarily restrict functions. Continuous availability or a successful sale is not guaranteed. Each member remains responsible for their own conduct and content. Liability is governed by applicable law; liability for intent, gross negligence and mandatory statutory liability is not excluded.
10. Privacy, changes and law
The privacy notice explains personal data processing. Changes to these terms do not apply retrospectively to purchases already concluded. Material changes to the platform relationship are communicated before they apply; any legally required consent is obtained.
Swiss law governs the relationship with the platform operator, subject to any mandatory applicable law. Mandatory jurisdiction rules and legal rights remain unaffected. Purchase contracts between members are governed by their validly agreed conditions and the applicable law.
11. Closing your account
You can request account deletion from the operator using the contact in the legal notice. You will no longer be able to sign in with that account, and its associated public content will be hidden. Save any personal records you need beforehand. Account deletion does not cancel an already concluded order or waive a payment due or accumulated commission. Existing orders, invoices and other necessary commercial records are retained securely as described in the privacy notice. The contact in the legal notice remains available for outstanding transactions and privacy requests.
